1. About FlexiSport Card

FlexiSport Card is a platform that connects users with participating sports and wellness facilities through a single membership or benefit program. We act as a facilitator between users, employers, and partner facilities.

FlexiSport Card does not own or operate sports facilities and is not responsible for the services provided by third party partners.

2. Eligibility

You must be at least 18 years old to use our services. By using FlexiSport Card, you confirm that you are legally able to enter into a binding agreement.

If you use FlexiSport Card on behalf of an employer or organization, you confirm that you have authority to bind that entity to these Terms.

3. Accounts and Registration

To access certain features, you may need to create an account. You agree to provide accurate and complete information and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

4. Memberships and Payments

Some services require paid membership or subscription.

By purchasing a membership, you agree to pay all applicable fees and taxes. Prices, plans, and billing cycles may change at any time and will be clearly communicated before changes take effect.

Payments are processed through third party payment providers. FlexiSport Card does not store full payment card details.

All payments are non refundable unless explicitly stated otherwise.

5. Use of Partner Facilities

Access to partner facilities is subject to each facility’s own rules, policies, schedules, and availability.

FlexiSport Card does not guarantee access, availability, or quality of services at any partner location.

You agree to follow all safety rules, facility policies, and local laws when using partner facilities.

Any issues, injuries, or disputes arising at a partner facility must be addressed directly with that facility.

6. Health and Safety Disclaimer

Physical activity involves inherent risks. By using FlexiSport Card, you acknowledge that participation in sports and fitness activities is voluntary and at your own risk.

FlexiSport Card does not provide medical advice. You should consult a qualified healthcare professional before starting any fitness or wellness activity.

We are not responsible for injuries, health issues, or damages resulting from your participation in activities offered by partner facilities.

7. Acceptable Use

You agree not to:

• Use the platform for unlawful purposes
• Share or misuse memberships or access credentials
• Attempt to disrupt or damage the website or services
• Misrepresent your identity or eligibility
• Abuse, harass, or harm other users or partners

We reserve the right to restrict or terminate access for any misuse or violation.

8. Intellectual Property

All content on FlexiSportCard.com including text, logos, branding, graphics, and software is owned by or licensed to FlexiSport Card.

You may not copy, modify, distribute, or use our content without prior written permission, except for personal, non commercial use.

9. Termination

We may suspend or terminate your access to the services at any time if you violate these Terms or if we discontinue the platform.

You may cancel your account or membership according to the cancellation terms applicable to your plan.

Upon termination, your right to use the services will immediately cease.

10. Limitation of Liability

To the maximum extent permitted by law, FlexiSport Card is not liable for any indirect, incidental, special, or consequential damages.

Our total liability for any claim related to the services will not exceed the amount you paid to FlexiSport Card in the previous twelve months.

11. Indemnification

You agree to indemnify and hold harmless FlexiSport Card, its employees, partners, and affiliates from any claims, damages, losses, or expenses arising from your use of the services or violation of these Terms.

12. Third Party Links and Services

Our website may contain links to third party websites or services. We are not responsible for the content, policies, or practices of third parties.

Your use of third party services is at your own risk.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised date.

14. Governing Law

These Terms are governed by the laws of the Province of Nova Scotia and the laws of Canada applicable therein.
